Pooled Trusts


Attention Senior Citizens and Concerned Family Members: Are you or your loved one in need of or currently utilizing home-care services, due to disability? Perhaps you are unable to begin or will need to discontinue such services due to their prohibitive costs.

If this situation describes you, we have good news: Disabled seniors can qualify for Medicaid, even with income over the Medicaid limits. To date, disabled seniors have been required to either ‘spend down' their surplus income on Medicaid-approved expenses, or refund this surplus income to Medicaid. However, recent rulings allowing the deposit of surplus monthly income into Supplemental Needs Trusts are making a significant difference for thousands of seniors in New York State. The Lifetime Care Foundation has a Community Pooled Trust operating as a Supplemental Needs Trust, which can allow you, upon advice of an attorney, to make monthly deposits of your excess income into the trust, and therefore become and remain Medicaid eligible. In turn, this money is now available to be disbursed for your benefit for reasonable living expenses. These trusts can enable seniors to use their excess income to pay for rent, utilities and medical services not covered by Medicaid. The Lifetime Care Foundation does not offer legal advice, therefore it is important to discuss this with your attorney and/or financial advisor in order to help maximize the benefits and services you are entitled to receive under current laws and regulations.

Supplemental Needs Trust
 A Supplemental Needs Trust is a legal document created for persons with physical, mental or developmental disabilities to have assets held in Trust for his or her benefit. Funds in a trust are not considered assets for purposes of certain governmental benefits. Parents and family of persons with disabilities who are doing estate planning, as well as persons receiving payment from lawsuits or other income who have disabilities, can use a Supplemental Needs Trust to hold assets for their use without endangering eligibility for Medicaid or SSI. The Lifetime Care Foundation manages a Pooled Community Trust which functions as a Supplemental Needs Trust.
